1. Scope of services

These terms of use govern the use of the website www.compando.ch and the content, functions and services offered through it by the Compando.ch GmbH (hereinafter «Compando»). By accessing the website or using individual services, you agree to these terms of use. There is no legal entitlement to access or use of the services offered. These terms of use apply exclusively to persons of legal age and legal capacity as well as to companies. Use of the platform by minors is not permitted without the consent of their legal guardians.

Compando operates a digital platform for the comparison, advice and brokerage of insurance, retirement provision and other financial solutions for private individuals, self-employed persons and companies in Switzerland.

The services may in particular include:

  • Provision of information, comparisons and market overviews
  • Analysis of needs and options
  • Obtaining and brokering offers
  • In-person, telephone or digital advice
  • Brokerage of insurance and retirement provision solutions
  • Forwarding of enquiries to suitable cooperation partners or registered intermediaries
  • Administrative support and general customer service

For the provision of services, Compando may cooperate with external partner companies, insurers, product providers, brokers or, where required, intermediaries registered with FINMA.

Technical access to the website and services, in particular internet connection, device and browser, is the responsibility of the user. Compando accepts no responsibility for limitations arising from the user's technical equipment.

The website is aimed at users in Switzerland. For access from countries in which access to such offerings is legally restricted, Compando accepts no responsibility. It is the responsibility of users to observe the provisions applicable to them.

2. Regulatory status and remuneration

Regulatory status

Compando is registered with FINMA as a non-tied intermediary (FINMA register number F01537536) and is subject to the Swiss Financial Market Supervisory Authority.

Further regulatory information can be found in the imprint and in the customer information sheet pursuant to Art. 45 ISA , which is provided on request or before the start of a consultation.

For complaints in connection with the brokerage activity, you can contact us at [email protected] . The Ombudsman of Private Insurance and of the Suva is available as an external mediation body (ombudsman-assurance.ch).

Remuneration and conflicts of interest

Compando is remunerated for brokerage and advisory services by insurance companies and cooperation partners in the form of brokerage fees, commissions or a predetermined amount per offer or contact enquiry. These are included in the offered premiums. This does not give rise to any additional direct costs for the customer.

As a non-tied intermediary, Compando is independent and not bound to individual insurance companies. Positions in a comparison cannot be purchased. The type and amount of the remuneration are set out in the customer information sheet pursuant to Art. 45 ISA . The remuneration actually received in the individual case is disclosed upon request.

3. Non-binding nature of website content

The content published on this website serves general information purposes and does not constitute a binding offer, assurance, investment advice, legal advice or individual recommendation, unless expressly agreed otherwise in writing.

Information on products, benefits, premiums, conditions or market comparisons is based in part on third-party sources and may change at any time. Only the respectively valid contract documents, policies and conditions of the relevant product provider are decisive.

4. Advisory services and scope

In addition to general use of the platform, Compando also provides individual advisory services (in person, by telephone or digitally). The following basic rules apply to these:

  • Personal advice is only provided upon the express request of the customer or on the basis of a separate advisory agreement.
  • For advisory errors, Compando is liable within the scope of the statutory provisions and the existing professional liability insurance.
  • General website content does not establish an advisory relationship. The liability exclusions in section 8 apply exclusively to general use of the platform, not to agreed advisory services.

5. Conclusion of contracts

Use of the website alone does not establish any advisory, brokerage or insurance contract. A contract is only concluded through an express written agreement with Compando or through the conclusion of a contract with an insurer, product provider or partner company.

Insurance contracts are concluded directly between the user and the respective insurance company. Compando is in principle not a party to the insurance contract, unless expressly agreed otherwise in writing.

6. Contact enquiries and data protection

When users submit an enquiry via the website, Compando may process it itself or forward it to suitable cooperation partners, advisors or registered intermediaries. By submitting an enquiry and agreeing to the privacy policy, users consent to the processing of their enquiry and to being contacted by telephone, email or another suitable means of communication.

Marketing communication only takes place within the legally permitted framework or with separate consent. You can unsubscribe from newsletters and other marketing communication at any time, for example via the unsubscribe link or by notifying [email protected]. There is no entitlement to brokerage, a response, an offer or the conclusion of a contract.

The processing of personal data is governed by the separate privacy policy of Compando in its respectively valid version.

7. Obligations of users

Users undertake to:

  • Provide truthful and complete information
  • Not transmit any unlawful or abusive content
  • Not carry out any technical interventions, manipulations or disruptions
  • Keep access data confidential, where user accounts exist
  • Respect the rights of third parties

Compando is entitled to restrict or block abusive enquiries or uses without prior notice. In the event of serious breaches of these terms of use or abusive use, Compando may terminate use with immediate effect. Any fees already paid for chargeable services are forfeited to Compando in such cases.

8. Liability

Compando is liable within the scope of the statutory provisions for damage caused by intentional or grossly negligent conduct. As far as legally permissible, liability for slight negligence is excluded.

No liability exists, as far as legally permissible, in particular for:

  • indirect damage or consequential damage as well as lost profit
  • system failures, data loss or technical interruptions
  • content or services of third parties (partner companies, insurers, intermediaries)
  • decisions that users make on the basis of general website content
  • the non-conclusion of contracts with third-party providers

Compando endeavours to ensure the most uninterrupted operation of the website possible, but accepts no warranty for the operation being uninterrupted, error-free or free of disruptions at all times, nor for the accuracy, reliability and completeness of the information provided. Compando may change or temporarily restrict content and services at any time.

These liability limitations apply exclusively to general use of the platform. For agreed individual advisory services, Compando is liable in accordance with the statutory provisions and the existing professional liability insurance.

From the website compando.ch, other websites are accessible via links. Compando accepts no warranty or liability whatsoever for these external websites and their content.

9. Right of withdrawal

For private individuals, a right of withdrawal may exist for distance contracts in accordance with the applicable statutory provisions. Compando primarily provides brokerage services. A separate contract with Compando is only concluded through an express written agreement. Any statutory rights of withdrawal remain unaffected.

10. Intellectual property

All content on the website, in particular texts, logos, trademarks, designs, images, software components, databases and graphics, is protected by copyright or otherwise. The designation «Compando» as well as other marks and logos used are registered trademarks. Without prior written consent from Compando, content may not be reproduced, distributed, made publicly accessible or used commercially.

The use, downloading or copying of content does not transfer any rights to the software, the content or other elements of the website to the user. For any republication, the prior written consent of Compando must be obtained.

11. Final provisions

Changes to the services and terms

Compando may adapt content, functions, services as well as these terms of use at any time. In the event of material changes affecting ongoing advisory mandates, affected customers will be informed within a reasonable period. For general use of the website, the respectively current published version applies. Earlier versions are replaced by the respectively new version.

Severability clause

Should individual provisions of these terms of use be or become wholly or partially invalid, the validity of the remaining provisions remains unaffected. In place of the invalid provision, a legally permissible arrangement applies that comes as close as possible to the economic purpose.

Governing language version

These terms of use are also available in French and English. In case of discrepancies, the German version prevails.

Applicable law and place of jurisdiction

As far as legally permissible, all legal relationships between users and the Compando.ch GmbH are subject exclusively to substantive Swiss law. The exclusive place of jurisdiction is Bern, Switzerland, unless mandatory statutory provisions provide otherwise.
